Terms & Conditions

Preface:

Unless otherwise accepted by written agreement with Excel Healthcare Limited only these present terms are accepted.

Duties:

All orders shall be taken in accordance with the “subject to company approval” clause and shall be binding on Excel Healthcare’s behalf only after the buyer receives Excel Healthcare’s acceptance. Excel Healthcare’s failure to accept any order shall not be grounds for any claims by the buyer for any reason.

Prices:

The prices quoted are indicative and are not binding and may be updated when the order is placed.

Deliveries:

Terms of delivery are indicative and are not binding on Excel Healthcare, who reserves the right to deliver according to availability. The buyer may not claim any compensation for damages in the event of delays or acts of God.

Minimum amount of orders:

Excel Healthcare reserves the right to charge a minimum order fee of fifteen pounds plus postage and packing.

Shipping:

If goods are to be delivered byExcel Healthcare’s contractual carriers said goods travel at buyers risk. Excel Healthcare accepts no liability for damage incurred after the goods leave it’s warehouse or factory. The buyer is therefore required to protect it’s own interests against carriers in accordance with the law.

Complaints:

The buyer must examine the integrity and conformity of the goods immediately after arrival and before they are used or altered in any way. Any complaints must be in writing and sent within fifteen days of delivery. Claims for damages as a result of defective goods are peremptorily denied. No disputes shall give the buyer the right to suspend payment of the supply. Thus under no circumstances shall the buyer have the right to raise objections regarding supply unless goods are paid in full.

Merchandise returns:

Goods must be accompanied by a written description of the reason for return in accordance of current laws within seven working days. Returns as a result of wrongful order or for reasons not chargeable to Excel Healthcare will be accepted only if the goods are returned to Excel Healthcare in pre-delivery condition. If the relative goods are found to be in perfect condition they will be credited to the buyer at the invoiced value less 22.5% as a contribution to checking and re-warehousing costs and administrative expenses.

Rental agreements on Steam Sterilisers:

A Rental period of 36 months applies to all rental sterilisers this is to be paid by monthly direct debit as advised on the accompanying invoice. Ownership of the rental steriliser remains the property of Excel Healthcare. All servicing, validations and repairs are the responsibility of Excel Healthcare. Annual cover includes 3 callouts & parts excluding the steam generator. Additional callouts will incur a cost of £60.50 + vat plus parts. At the end of the 36 month period the rental steriliser will be collected by Excel Healthcare, this can be renewed or upgraded. The rental contract is for a 36 month period, if you wish to terminate this contract early then a 20% charge of the initial invoice will be required.

Contracts are non transferable.

Unfortunately we are unable to offer any rental plans, monthly purchase plans, services or repairs to those customers based in Ireland / Northern Ireland.

Annual Autoclave Service Plan

The Annual Comprehensive Service Plan is a rolling contract. An invoice will be issued annually the month your service is due, this will be issued prior to your service being carried out. All payments are taken by Direct Debit, please complete this at checkout. Excel Healthcare will conduct an annual service on the unit incorporating a series of calibration tests with a written scheme of examination and will issue certification reports to verify effective sterilisation and pressure vessel worthiness.

The annual  plan will include parts and labour costs unless the repair is caused by customer error, for example a blocked steam generator will be caused by not using distilled water and any general maintenance such as not tightening your door will not be covered. In the unlikely event of any breakdown on the contracted autoclave repairs will be carried out quickly and efficiently. We will endeavour to attend within a 72 hour working day period of notification. These repairs will be carried out under the Excel Healthcare warranty scheme and will be free of any charges.

Please ensure you make note of your service month and that you contact Excel Healthcare when due either via phone, email or on our website.

Cancellation: Either party can terminate the plan. Cancellation will be required one month prior to your invoice date in writing with written acknowledgment from Excel Healthcare or payment will be required and not refundable. Cancellation of your Direct Debit will incur immediate cancellation of your plan.

Late Payments: If payment is not made on the date the Direct Debit should be taken a late payment fee will occur. The fee will be 8% of the monthly payment plus £15 administration fee. If payments are continuously late then this will result in the autoclave being collected.

Annual Autoclave Service / Autoclave Chargeable Repair

When placing  an order for the Annual Autoclave Service or chargeable repair we will require your Direct Debit details to take payment for any repair that will be carried out on our visit. You will be notified by email of the amount due to be taken. Please complete these details at checkout.

Monthly Purchase Plans:
Unfortunately we are unable to offer any rental plans, monthly purchase plans, services or repairs to those customers based in Ireland / Northern Ireland.

Direct Debits:

Payment by direct debit is our only available option for monthly instalments for sterilisers and our service plan. On signing the contract agreement the customer promises to pay for the full term of the agreement. If a payment is missed then full payment is required within 30 days. If the Direct Debit is cancelled then it will be reinstated for the term of the contract and any amount owing will be collected and monthly payments reinstated. If the Direct Debit is cancelled again then the goods must be available for collection, the outstanding amount owing will remain. All products are covered by a one year manufacturer’s warranty except where stated. The warranty does not apply where the goods have been improperly altered in any way whatsoever, subject to misuse or unauthorised repair. This will result in additional charges. Excel Healthcare shall have exclusive ownership of the delivered merchandise until payment has been made in full unless this is a rental steriliser where this will always be the property of Excel Healthcare. Excel Healthcare is FCA certified for monthly payments to be taken. All our customers must have an active Direct Debit with Excel Healthcare Ltd advance notice will always be given for any future payments by email.

Contracts are non transferable.

Payments:

Payments must be made in accordance with the relative invoice conditions. When the expiration date indicated has passed Excel Healthcare reserves the right to charge interest at the prime rate plus 0.5 points above base rate at the same time require immediate payment for all goods supplied.

Warranties:

Warranty details for the relevant products are displayed on this website under the product information if applicable. Most products are usually supplied with a one year manufacturers warranty unless otherwise stated. The relevant warranty terms will not apply where the goods have been improperly altered in any way whatsoever, subject to misuse or unauthorised repair e.g. not following operating instructions on using DISTILLED water in steam sterilisers. This will result in additional charges above any warranty or servicing agreement.

Reservation of ownership:

Excel Healthcare shall have exclusive ownership of the delivered merchandise until payment has been made in full.

Late Payment Interest & Charges

“We reserve the right to claim statutory interest at 8% above the Bank of England reference rate in force on the date the debt becomes overdue and at any subsequent rate where the reference rate changes and the debt remains unpaid in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 as amended and supplemented by the Late Payment of Commercial Debts Regulations 2002.”

Please note any missed payments or invoices not being paid on time late payment charges will be incurred (Statutory Late Payment Charges in accordance with the 1998 Act and 2002/2013 amendments) along with fixed penalty charge depending on the sum owed. All the Invoices must be paid within 30 days from the date of Invoice.

Jurisdiction:

The British courts shall have jurisdiction over any and all disputes.
